So, here's the low down..
Basically, the EU has passed new legislation that better protects the privacy of European citizens. So you're probably thinking, "so how does it affect us over here in little old Aus?", well, the effect is pretty significant if you have customers or mailing list subscribers based in the EU.
The GDPR requires formal consent when users join a mailing list, and it needs to be explicit, so if you ask a user to join a mailing list they need to also be asked if they 'agree to be emailed', and in addition they also need to be asked if they agree to have their 'email activity tracked'. Both these questions need to be separate tick boxes!
In addition to the above, links to Privacy and Cookie policies need to be clearly available adjacent to, or beneath the subscribe form.
Big fines apply for breaches of the policy, and yep, EU courts have the reach to pursue fines and prosecution here.
